Terms of Service

PivotPoint is a career-change tool that allows you to upload a résumé, select a target role, and receive an AI-generated skill-gap analysis, transferable-skill map, month-by-month learning roadmap, and a pivot-ready résumé draft (collectively, the "Service"). The analysis is powered by OpenAI's large-language-model API and is provided for informational and planning purposes only.

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction, whichever is higher) to use the Service. If you are located in the EU, the minimum age is governed by the GDPR Art. 8 age of consent (13–16 depending on your country). By using the Service you represent that you meet this requirement. If you are under 18, you must have a parent or guardian's consent.

We use Google OAuth 2.0 for authentication. By signing in you authorise us to receive your Google account's name, email address, and profile picture. This is governed by Google's Terms of Service and Google's Privacy Policy. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must not share your credentials or allow others to access your account.

You agree not to:

• Upload résumés or other content that you do not own or have the right to use.
• Use the Service to generate content that is unlawful, harmful, defamatory, or otherwise objectionable.
• Attempt to reverse-engineer, scrape, or circumvent any security measure of the Service.
• Use automated tools to send bulk requests to the Service without our prior written consent.
• Impersonate any person or entity.
• Use the Service in any way that violates applicable local, national, or international law or regulation, including but not limited to the GDPR, CCPA, and India's DPDPA 2023.

You retain all ownership rights to the résumé and any other content you upload ("User Content"). By uploading User Content you grant PivotPoint a limited, worldwide, royalty-free licence to process, transmit, and display your User Content solely to operate and improve the Service.

We do not sell your résumé or User Content to third parties. Your résumé text is sent to OpenAI solely to generate your analysis and is governed by OpenAI's Privacy Policy and OpenAI's Usage Policies. We do not use your résumé to train AI models.

Journey history (analysis results) is stored in your browser's localStorage and is not transmitted to our servers beyond what is required to generate the analysis.

The PivotPoint name, logo, product design, and all content created by us (excluding User Content and AI-generated output) are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, or distribute them without our prior written consent.

AI-generated output (skill-gap analyses, roadmaps, résumé drafts) is provided to you for your personal, non-commercial use. You may edit and use this output as you see fit, but we make no warranty as to its accuracy or fitness for any purpose.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Any AI-generated career advice, skill-gap analysis, or roadmap is accurate, complete, or suitable for your specific situation.
• Following the roadmap will result in employment.

AI-generated content is not a substitute for professional career counselling, legal advice, or HR guidance.

To the maximum extent permitted by applicable law, PivotPoint and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $10.

The Service integrates with the following third-party providers, each governed by their own terms and privacy policies:

• Google — authentication via OAuth 2.0 (Privacy Policy)
• OpenAI — AI analysis engine (Privacy Policy)

We are not responsible for the practices of any third-party service.

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including breach of these Terms. You may stop using the Service at any time. Upon termination, the licences granted to you will cease, but provisions that by their nature should survive (such as intellectual property, disclaimer, and limitation of liability) will remain in effect.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India. If you are a consumer in the European Union, you may also benefit from the mandatory consumer protection provisions of your country of residence under the EU Consumer Protection Directive.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after the revised Terms are posted constitutes your acceptance of the changes. If the changes are material, we will make reasonable efforts to notify you (for example, via the app interface).
